Draft: this document describes how Shootika works today, but it has not been through legal review. Treat it as informative rather than final.

Who these terms are between

These terms are between you, the merchant who installs Shootika on a Shopify store, and DIMENSO L.L.C-FZ, the company that builds and runs it. Below, "you" means the store and the people you let use it, and "we" means Dimenso.

Installing Shootika, or using it, means you accept these terms. If you are accepting on behalf of a business, you are confirming that you are allowed to bind it.

Shootika is distributed through the Shopify App Store and runs against a Shopify store, so Shopify sits between us in several places: it handles the install, it handles the billing, and it has its own agreement with you that we are not a party to.

What Shootika does

Shootika reads the product images already attached to your Shopify products and generates on-model and lifestyle photography from them. When you approve a frame, it adds that frame to the product in Shopify as a product image. When you take a frame down, it removes that same image again.

Adding and removing its own frames is everything Shootika writes to your product pages. It does not change your prices, your stock levels or your product text, it does not publish or unpublish anything, and it does not create or delete products. The one other thing it touches on your Shopify account is the subscription, and the billing section below says exactly what it does there.

There is no part of Shootika on your storefront. Nothing about it is visible to your shoppers, and it has no dealings with them at all.

Your content and your store

Your product images are yours. Nothing here transfers them to us, and we make no claim on your catalogue, your brand or your store.

You need the rights to the pictures you give it. Product photography often shows people, and the frames Shootika produces are pictures of people by design, so you are responsible for holding whatever permissions, releases and licences those images need where you sell. If you do not hold them, do not put the image through Shootika.

You give us permission to do the things the app plainly has to do with your images in order to work at all: read them from Shopify, send them to be processed, generate frames from them, store the result, and write a frame you approved back to your product. What you may then do with a frame it gives back is set out in the image licence rather than here.

Your product images may also be used to train and improve the models behind Shootika. The privacy policy explains that, and how to ask us to exclude your store.

Plans, frames and billing

Billing runs through Shopify. When you pick a paid plan, Shootika creates an app subscription on your Shopify account and sends you to Shopify to approve the charge. Shopify bills you on the plan cycle, which is monthly for every plan on the pricing page, Shopify takes the payment, and we never see your card details.

Creating that subscription is a change Shootika makes to your Shopify account, and it is not the only one. It cancels that subscription when you cancel your plan, when you move down to the free plan, and when you change your billing cycle.

When you move between paid plans, Shootika does not cancel anything. It creates the replacement subscription and Shopify asks you to approve it, and ending the old one is Shopify to do, not us. Each of these follows from something you asked for in the app.

If a plan ever charges for use beyond its allowance, Shootika records those as usage charges against that same Shopify subscription, the one you already approved. No plan on the pricing page charges for that today. When your allowance runs out, generation stops.

Creating that subscription, cancelling it, replacing it, and recording usage charges against it are the only things Shootika does to your Shopify billing.

What happens next depends on which kind of allowance you have. A monthly allowance refills at the start of each calendar month. The frames on the free plan are a one-time grant given when you install, not a monthly allowance, so they do not refill: once they are used up, the way to carry on is a paid plan.

A frame is one finished image. One frame costs one credit against your plan, and the credit is taken when the job starts rather than when you publish the result. If a job fails, Shootika returns the credit automatically, and if it has to retry a job itself, that retry does not cost you a second credit.

A draft you generate and then decide against has already cost its credit. We would rather state that here than have you work it out from your balance.

There is also a ceiling on how many generations a store can run in a day, set independently of your plan as a guard against runaway cost. It is a configuration value rather than a promise, so these terms describe the rule and not the number.

You can change or cancel your plan from Shootika inside your Shopify admin. When you cancel it there, Shootika hands the cancellation to Shopify, which settles the part-finished billing period under its own proration rules.

Prices and allowances are not repeated here. They are on the pricing page, and a second copy of a price inside a legal document is a copy that goes stale without anyone noticing.

Acceptable use

Use Shootika on your own products, with images you have the right to use. That is the whole of the intended use, and most of what follows is that sentence with its edges drawn in.

Do not give it images you do not hold the rights to, images of a person who has not agreed to appear in them, or images of children. Do not use it to produce sexual content, to produce material that misleads a shopper about what a product actually is, or to produce anything that is illegal where you or your customers are.

Do not try to break it. No attempting to reach another merchant store or its images, no probing or overloading the service, no reselling access to it, and no using it to build a competing product.

We do not review what you generate before it is generated. Nothing here is a claim that Shootika screens your images, or its own output, for any of this. If we find that a store is doing one of these things, we can suspend it or end this agreement.

What we do not guarantee

Shootika makes photographs with AI image models. The output varies, it is not always usable, and a frame that looks right to us may not look right to you. We do not promise that a given generation will succeed, will match a reference, or will be fit to publish.

We do not promise that the service is available without interruption. It depends on Shopify, on cloud infrastructure, and on the image-generation providers behind it, and any of them can be down.

We do not promise that a frame is free of the mistakes these models are known for. Look at a frame before you publish it. You are the one deciding what goes on your product page.

Beyond what the law where you are will not let us disclaim, Shootika is provided as it is, with no warranty attached.

Uninstalling

You can uninstall Shootika from your Shopify admin whenever you like. Uninstalling ends this agreement, and Shootika closes your plan on its own side. The subscription itself is held by Shopify rather than by us, so your Shopify admin is the place to confirm it has ended.

When you uninstall, Shopify tells Shootika, and Shootika discards the access token and every other credential it held for your store. From that moment it cannot read your catalogue and cannot write anything to your products, whatever else it still holds.

The frames you already published stay on your products. Shopify holds its own copy of every image you added, it sits in your Shopify account and stays under your control, and nothing about the uninstall reaches it. Uninstalling does not strip your product pages. What you may do with a frame is still the image licence to answer, and uninstalling does not change that either.

What Shootika holds on its own side does go. After a grace period following the uninstall, and again if Shopify sends us a redaction request for your store, Shootika deletes the generated images it still stores for you, the ones you had published included. The length of that grace period is a setting rather than a promise, so these terms describe the rule and not the number.

The records of what happened stay: your credit ledger, and the history of what was generated and published. Reinstalling starts a fresh install rather than restoring what was deleted.

Liability

As far as the law allows, we are not liable for lost profits, lost sales, lost data, or any indirect or consequential loss arising from your use of Shootika.

Where we are liable, our total liability for all claims is limited to the amount you paid for Shootika in the twelve months before the claim arose.

You are responsible for what you publish. If someone brings a claim against us because of an image you gave Shootika, or because of a frame you put on a product, that is yours to answer and to cover.

None of this limits any liability that the law does not allow us to limit, such as liability for fraud, or for death or personal injury caused by negligence.

Changes

If these terms change, the date at the top changes with them. Where a change materially affects what you are agreeing to, we will tell merchants directly rather than rely on anyone noticing a date.

We can change what Shootika does, including adding, altering and removing features, and we can change what a plan costs. The pricing page is always the current version, and a price change takes effect on your next billing cycle rather than the one you are in.
